Assemblymember Dilan: Independent Medical Examiners help protect Incarcerated Individuals, restore trust in correctional facilities and give families peace of mind

“Public trust in our justice system relies on transparency and accountability. Reports revealing that between 2000 and 2023, 199 incarcerated individuals have their cause of death recorded as “unknown,” underscores the urgent need for independent oversight. The establishment of a state-wide independent Office of Chief Medical Examiner (A.6599-B) addresses this issue directly by investigating the cause of death, addressing errors in the initial report, and most importantly providing peace of mind to families.

“Under current practice, investigations into incarcerated deaths are conducted by local county coroners, who often lack the specialized training and expertise necessary for investigative oversight. Furthermore, their close relationships with local law enforcement and correctional staff oftentimes hinders their ability to conduct fully independent investigations.

“As chair of the Assembly Correction Committee, passage of my Chief Medical Examiner bill by the Assembly Correction Committee is an important step toward protecting the humanity of incarcerated individuals and restoring public trust in the justice system.”
