TITLE OF BILL:
An act to amend the racing, pari-mutuel wagering and breeding law, in
relation to the distribution of surcharges on off-track winnings
 
PURPOSE OR GENERAL IDEA OF BILL:
To extend the current authorization for the distribution of surcharge
revenues which will otherwise expire on August 31, 2022.
 
SUMMARY OF SPECIFIC PROVISIONS:
This bill would allow the allocation of specific surcharge revenues to
the same racetrack to continue for another five year period.  
EFFECT ON
CURRENT LAW:
Changes the expiration date from August 31, 2022 to August 31, 2027, in
keeping with the length of previous extensions.
 
JUSTIFICATION:
This is more a matter of "housekeeping" than anything else. Every five
years, the provision for the distribution of surcharge earnings from
off-track winning bets has expired. This year, 2022, is the year during
which the last five year extension expires necessitating another exten-
sion in order to continue to implement earlier agreements. Passage of
the last extension was accomplished without a negative vote.
 
PRIOR LEGISLATIVE HISTORY:
Chapter 365 of 2009 restored an inadvertent omission of the five year
extension provision from a renumbering and re-ordering of several racing
law provisions.

AN ACT to amend the racing, pari-mutuel wagering and breeding law, in
relation to the distribution of surcharges on off-track winnings
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraph (vi) of paragraph b of subdivision 3 of
2 section 532 of the racing, pari-mutuel wagering and breeding law, as
3 amended by chapter 243 of the laws of 2020, is amended to read as
4 follows:
5 (vi) for the period of September first, two thousand [seventeen] twen-
6 ty-two until August thirty-first, two thousand [twenty-two] twenty-seven
7 and where the track conducting the race on which the bet was placed is a
8 harness track located in the county of Erie, to such track.
9 § 2. This act shall take effect September 1, 2022.
