  TITLE OF BILL: An act to amend the public authorities law, in relation to authorizing and directing the metropolitan transportation authority to implement a fare refund program for canceled or delayed Long Island Rail Road trains   PURPOSE OR GENERAL IDEA OF BILL: to implement a fare refund program for canceled or delayed Long Island rail road trains   SUMMARY OF PROVISIONS: Section 1: Section 1266 of public authorities law is amended by adding a new subdivision 19. Notwithstanding other provisions of law or terms of any contract, the authority and its subsidiary corporations involved with the Long Island rail road would establish and implement a fare refund program for the Long Island rail road when a train is canceled or delayed by more than ten minutes and issue full refunds to each affected rider's fare. The fare refund program shall be operational during all hours the authority provides railroad, subway and/or omnibus services, not being limited to off-peak hours or hours designated by authority. However, the fare refund program may be suspended temporarily when an emergency situation arises. Section 2: Provides the effective date.   JUSTIFICATION: To hold them responsible and accountable; and provide a punitive mech- anism for Long Island Rail Road failure.   PRIOR LEGISLATIVE HISTORY: 2019-2020: A.6355 - referred to Corporations, Authorities and Commis- sions 2021-2022: A.4315 - referred to Corporations, Authorities and Commis- sions   FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENTS: None   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to amend the public authorities law, in relation  to  authorizing
          and directing the metropolitan transportation authority to implement a
          fare  refund  program  for  canceled  or delayed Long Island Rail Road
          trains

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  1266 of the public authorities law is amended by
     2  adding a new subdivision 20 to read as follows:
     3    20. Notwithstanding any other provisions of law or the  terms  of  any
     4  contract, the authority, and any of its subsidiary corporations involved
     5  with  the  Long  Island  Rail Road, shall establish and implement a fare
     6  refund program for the Long Island Rail Road. The  fare  refund  program
     7  shall,  when  a  train  is canceled or delayed by more than ten minutes,
     8  issue refunds for the full amount of each  affected  rider's  fare.  The
     9  fare  refund program established and implemented pursuant to this subdi-
    10  vision shall be in operation during all hours in  which  such  authority
    11  provides  railroad,  subway  and/or  omnibus  services, and such program
