TITLE OF BILL:
An act to amend the education law, in relation to increasing the cap on
earnings for eligible individuals with no dependents receiving tuition
assistance program awards
 
PURPOSE:
Relates to increasing the cap to $30,000 on earnings for eligible indi-
viduals with no dependents receiving TAP awards.
 
SUMMARY OF PROVISIONS:
Section one amends § 667 of the education law, to increase the earnings
cap associated with TAP eligibility for single, independent undergradu-
ate students to $30,000 per year.
Section two provides the effective date.
 
JUSTIFICATION:
The current max earning for a single, independent undergraduate student
with no tax dependents receiving TAP awards is currently $10,000 accord-
ing to Education Law Section 667 (3)(a) (iii)(A). A young adult who no
longer lives with his/her parents that earns $15,000 annually, for
instance, does not qualify for TAP despite being, by virtually all meas-
ures, in need of financial assistance to attend college. This legis-
lation seeks to make TAP more accessible to single, independent under-
graduate students.

AN ACT to amend the education law, in relation to increasing the cap on
earnings for eligible individuals with no dependents receiving tuition
assistance program awards
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Item 2 of clause (A) of subparagraph (iii) of paragraph a
2 of subdivision 3 of section 667 of the education law, as amended by
3 section 3 of part H of chapter 58 of the laws of 2011, is amended to
4 read as follows:
5 (2) Three thousand dollars or Thirty-one per centum of
6 more, but not more than [ten] amount in excess of three
7 thirty thousand dollars thousand dollars
8 § 2. This act shall take effect immediately.
